Assignment # 2 - Unlawful Detainer
2.1 You will receive a blank set of forms in class for Unlawful
Detainer - including the complaint and the answer. We will cover
each form in class, and then you are to fill in the forms with
your own name, and client information. (note: the blank forms
can be obtained under court
forms, jurisearch,
or americanlegalnet.com
if you ever need them in the future.
2.2 We will review the rationale, holding, and measure of damages
in the Green Case under the legal theory of "warranty of
habitability. Read the Green
Case and summarize the court's holding, how the court calculates
damages in a "breach of warranty of habitability case"
and the rationale for the holding (decision) in one page. Post
your analysis here. This is not a full brief, just the holding
and rationale and damages.
2.3 Draw up a "time line" for an Unlawful Detainer
(Eviction Case) - California law - from the "Three Day (3)
Notice" to the eviction, according to instructions received
in class.
